POLICY
Lake Court Medical sells only to authorized dealers, medical facilities and hospitals.
TERMS
Net 30-Days upon credit approval. Late payments are subject to a $25.00 late payment charge. Past due invoices are subject to 1.5% per month interest. Visa, MasterCard and American Express can be used for payment at time of purchase. There will be a $10.00 handling fee for all credit card transactions that are not processed at time of order.
PRICING
All prices are F.O.B. point of shipping. Prices are listed in U.S. Dollars and Lake Court Medical reserves the right to change prices without prior notice.
FREIGHT
Free freight is available on qualifying orders over $750.00 delivered to ONE location and within the LCM delivery area.
Free freight does not apply to any special handling (Next Day Air, lift gate service, inside delivery, residential delivery, oversized items, etc.).
DROP SHIPS
All drop shipments and special orders are subject to freight & handling charges if applicable.
ORDERS
All orders under $750.00 may be assessed shipping and handling fees whether delivered by LTL carrier or a Lake Court Medical vehicle. Orders under $750.00 that are delivered by a Lake Court Medical vehicle within the Lake Court delivery area will be assessed a $30.00 processing and handling fee. Any special handling or fuel surcharge assessed to Lake Court Medical by the manufacturer will be passed on to the customer. Special orders may require a deposit at time of order.
FUEL CHARGES
Regardless of the freight minimum, all fuel surcharges and related handling fees incurred for LTL deliveries will be billed. A reasonable and customary fuel surcharge will be added to each delivery by a Lake Court Medical vehicle.
CLAIMS FOR SHORTAGES
Claims for shortages must be made within 24 hours of receipt of merchandise.
WARRANTIES
All items purchased from Lake Court Medical will be considered under manufacturers’ warranty guidelines. All warranty returns must have prior authorization from Lake Court Medical’s Customer Service Department.
RETURNS
All merchandise returned must have prior authorization from Lake Court Medical’s Customer Service Department.
All unauthorized returns will be refused and returned to sender. Invoice numbers or customer P.O. numbers, along with serial number or date codes, must accompany all requests for return. Returns must be made within 30 days and must be in the original packaging and in re-stockable condition. All returns are subject to a minimum 25% restocking/handling fee. Special orders, private labels, custom parts, discontinued items, and any assembled equipment are not eligible for return.
TACTILE MEDICAL (AFFLOVEST)
DME PROVIDER RESPONSIBILITY. The DME Provider agrees to service its AffloVest patients for the entire five-year Useful Life that insurance attaches to durable medical equipment products.
QUALITY AGREEMENT. By selling Tactile products, ie.: AFFLOVEST, the DME Provider agrees to immediately, (within 24 hours), notify Lake Court Medical Supplies of any product-related complaints, injuries, or adverse events. Product complaints are to be directed to returns@lakecourt.com. The DME Provider shall make all reasonable efforts to aid Lake Court Supplies in complaint or reportable event investigations. By distributing Tactile products, the DME Provider agrees to maintain distribution records for all Tactile products. In the event of a Tactile product recall, the DME Provider shall make all reasonable efforts to aid Lake Court Medical Supplies & Tactile in the recall of affected product. The DME Provider shall maintain distribution records for the useful life of the device, or five years from the date of distribution, whichever is longer.
RECORD-KEEPING. DME Provider further agrees to comply with all laws, regulations and instructions relating to: (a) storage and selling of durable/home medical equipment, (b) durable/home medical equipment record-keeping requirements (including but not limited to collection of prescriptions); and (c) maintaining records of serial and or batch numbers of Products dispensed to patients.
RIGHT-TO-AUDIT. The Products tracked by the FDA in accordance with 21 CFR 821 have specific traceability requirements. Tactile reserves the right to conduct periodic audits of DME Provider to assess DME Provider’s capabilities to properly track the Products. DME Provider will be required to keep accurate and current tracking information for the useful life of the Product and shall make any records required available to Tactile or FDA. A distributor, final distributor, or multiple distributors, after purchasing a Product shall promptly provide Tactile with accurate and current tracking information pursuant to the tracking requirements required by 21 CFR 821.30 or any other applicable regulation.
MINIMUM ADVERTISED PRICE. DME Provider will not advertise pricing below M.A.P of $15,900. The pricing displayed on all websites, catalogues and other published or online content must be at or above the agreed M.A.P
