Policy

Lake Court Medical Supplies sells only to authorized dealers, medical facilities, and hospitals.

Payment Terms

Payment terms are net 30 days upon credit approval. Late payments are subject to a $25 late-payment charge. Past-due invoices are subject to interest at 1.5% per month.

Visa, Mastercard, and American Express may be used for payment at the time of purchase. A $10 handling fee will apply to credit card transactions that are not processed at the time of order.

Pricing

All prices are F.O.B. point of shipment and are listed in U.S. dollars. Lake Court Medical Supplies reserves the right to change prices without prior notice.

Freight

Free freight is available on qualifying orders over $750 delivered to one location within Lake Court Medical Supplies’ delivery area.

Free freight does not apply to special-handling services or charges, including next-day air, liftgate service, inside delivery, residential delivery, oversized items, limited-access delivery, or similar services.

Drop Ships

All drop shipments and special orders are subject to applicable freight and handling charges.

Orders

Orders under $750 may be assessed shipping and handling fees, whether delivered by an LTL carrier or a Lake Court Medical Supplies vehicle.

Orders under $750 delivered by a Lake Court Medical Supplies vehicle within Lake Court’s delivery area will be assessed a $30 processing and handling fee.

Special-handling charges or fuel surcharges assessed to Lake Court Medical Supplies by a manufacturer will be passed on to the customer. Special orders may require a deposit at the time the order is placed.

Fuel Charges

Regardless of the freight minimum, all fuel surcharges and related handling fees incurred for LTL deliveries will be billed to the customer.

A reasonable and customary fuel surcharge will be added to each delivery made by a Lake Court Medical Supplies vehicle.

Claims for Shortages

Claims for shortages must be submitted within 24 hours after receipt of the merchandise.

Warranties

Items purchased from Lake Court Medical Supplies are subject to the applicable manufacturer’s warranty guidelines. All warranty returns require prior authorization from Lake Court Medical Supplies’ Customer Service Department.

Returns

All merchandise returns require prior authorization from Lake Court Medical Supplies’ Customer Service Department. Unauthorized returns will be refused and returned to the sender.

The applicable invoice number or customer purchase order number, along with serial numbers or date codes, must accompany every return request. Returns must be made within 30 days and must be in the original packaging and in resalable condition.

All returns are subject to a minimum 25% restocking and handling fee. Special orders, private-label products, custom parts, discontinued items, and assembled equipment are not eligible for return.

Tactile Medical (AffloVest)

DME Provider Responsibility

The DME Provider agrees to service its AffloVest patients for the entire five-year useful life that insurance assigns to durable medical equipment products.

Quality Agreement

By selling Tactile products, including AffloVest, the DME Provider agrees to notify Lake Court Medical Supplies immediately, and within 24 hours, of any product-related complaint, injury, or adverse event. Product complaints must be directed to returns@lakecourt.com.

The DME Provider shall make all reasonable efforts to assist Lake Court Medical Supplies with complaint or reportable-event investigations. By distributing Tactile products, the DME Provider agrees to maintain distribution records for all Tactile products.

In the event of a Tactile product recall, the DME Provider shall make all reasonable efforts to assist Lake Court Medical Supplies and Tactile with the recall of affected products. The DME Provider shall maintain distribution records for the useful life of the device or five years from the date of distribution, whichever is longer.

Record-Keeping

The DME Provider further agrees to comply with all laws, regulations, and instructions relating to: (a) the storage and sale of durable or home medical equipment; (b) durable or home medical equipment record-keeping requirements, including the collection of prescriptions; and (c) maintaining records of serial numbers or batch numbers for products dispensed to patients.

Right to Audit

Products tracked by the U.S. Food and Drug Administration in accordance with 21 CFR Part 821 have specific traceability requirements. Tactile reserves the right to conduct periodic audits of the DME Provider to assess the DME Provider’s ability to properly track the products.

The DME Provider must maintain accurate and current tracking information for the useful life of the product and make required records available to Tactile or the FDA. After purchasing a product, a distributor, final distributor, or multiple distributors shall promptly provide Tactile with accurate and current tracking information pursuant to 21 CFR 821.30 or any other applicable regulation.

Minimum Advertised Price

The DME Provider shall not advertise AffloVest below the minimum advertised price (MAP) of $15,900. Pricing displayed on websites, in catalogs, or in other published or online content must be at or above the agreed MAP.
